ACCEPTANCE OF TERMS

 

By accessing the content of www.motorcycleshop.ie (the Website) you agree to be bound by the terms and conditions set out herein and you accept our privacy policy available at www.motorcycleshop.ie . If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately.

 

You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

 

You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

STOCK AND DELIVERY
Please note the site is not a live stock list, we do try to keep the majority of items listed on the site in stock at all times, while we try to reorder as fast as possible and keep stock levels full, items will go out of stock from time to time! if an item in your order is not in stock we will adjust your order status and you will be sent an email notification, -alternatives, refunds or delivery ETA can be arranged. While most orders once shipped take about 1 working day please allow at least 2 days for delivery. If you need an item ASAP please contact us and we can advise or assist you as best as possible  

 

FREE POSTAGE OFFER

Free postage offers shall only apply to Republic of Ireland and UK mainland addresses and may be withdrawn at any time without notice. If items are out of stock and delivery will be delayed, the customer will be notified. Refunds will have the cost of original postage deducted from amount paid.

 

MODIFICATION

 

Motorcycleshop.ie reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

 

Motorcycleshop.ie have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

 

LIMITATION OF LIABILITY

 

Motorcycleshop.ie will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.

 

Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of motorcycleshop.ie, its employees or agents.

For online card payments under no circumstances will we hold sensitive payment details such as your card number, expiry date and security code. All online card payment transactions are handled through our accredited payment bureaus, Paypal. Realex payments.

4.     Your preferences and use of email updates, recorded by emails we send you (if you select to receive email updates on products and offers).

6.     Data recorded by the Website which allows us to recognise you and your preferred settings, this saves you from re-entering information on return visits to the site. 2.     In certain cases we may use your email address to send you information on our other products and services. In such a case you will be offered the option to opt in/out before completing your purchase.

 

We may need to pass the information we collect to other companies for administrative purposes. We may use third parties to carry out certain activities, such as processing and sorting data, monitoring how customers use the Website and issuing our e-mails for us. Third parties will not be allowed to use your personal information for their own purposes.

Product Returns & Cancellations Policy

(Please contact us before returning an item)

Occasionally we do get things wrong or the item you receive is not quite what you hoped for.

Goods which prove unsuitable may be returned for refund, credit or exchange if they are returned to ourselves within 14 days of receipt. Subject to the following conditions: 

Items should be returned unused in their original condition in order to secure a refund.

Items are returned complete with all packaging in good condition. (We reserve the right to levy a charge to replace product packaging which is damaged or defaced).  

Items returned after 14 days from receipt may be subject to a restocking charge of not less than 10%. This does not affect your statutory rights.

We cannot accept any items which have been specially ordered for you or manufactured to your specification for return.

All returns we must be notified via email if you have an item to return. Returns are to be accompanied by the senders name and address, order reference number (these are found on the invoice), and reason for return.

We cannot accept responsibility for returned parcels which are undelivered, please retain your proof of postage etc., you may require it on the event of a claim with your carrier.

 

Motorcycleshop.ie is not responsible for any labour charges incurred during fitment or removal of allegedly faulty (or incorrectly supplied) parts.

Please advise our Customer Service Department of any problems with shortages or carrier damage within 5 days of receipt.  We regret that beyond this time, due to circumstances beyond our control we may be unable to process your claim.

The cost of the return and the method used is up to the customer. 

Exclusions:

 We are unable to refund:

Used items: Such items are not resalable not least because of safety concerns. We strongly recommend you do not go out on your bike with your new gear until you are completely satisfied that you do not require a refund. We classify items as used if the original hang tags are removed.

Items damaged in transit: Sending items back in their product packaging only is not enough; items to be returned should be properly protected on their journey back with all the packaging we used to send it to you, including the product packaging and the corrugated outer box. If you send it back any other way you risk the item becoming damaged in transit and consequently you will lose all or part of your refund. The minimum handling charge for items not properly packaged is €20.00.

Special Orders: We are also unable to refund deliveries we have made to you that were special orders. We may agree to take back a special order but you need to let us know first with your order number and the items from the order to be returned.

Batteries and battery acid: Hazardous goods transport regulations make the domestic return of these goods impossible.

Gift Vouchers: There can be no refund of money for gift vouchers, items bought by a gift voucher still have the same refund rights.

The original delivery charge.

Exceptions: If you return an item for a refund which triggered a saving or discount on your original order (for example free delivery or a saving on an associated item). The refund will be adjusted to remove the original saving or discount which no longer applies.

 

Important notes

We do not accept liability for any consequential or incidental damages or for any other indirect, special or punitive damages whatsoever that arise out of or are related to the purchase or use of any products or services from the site through us.

While we work hard to ensure that the content on the site is accurate and current, we can't guarantee that the content will be free from error. We exclude any liability for any errors and omissions on the site. We also reserve the right to cancel and refund any order up to the point of delivery due to an error. the processing of a payment and acknowledgement of an order does not constitute a legally binding contract and we do not accept an order until we process it.

The access or use by you of the contents of this website is entirely at your own risk. We do not make any representation or warranty and expressly disclaim any and all such warranties and terms in respect of any products, services, information or materials.
